ok listen up all you people sending in speeding tickets and asking for info. There are tons of files and paperwork regarding this in the files section anyway.….… BUT … under the road traffic offenders act 1988 section 1, they only have 14 days from the date of the alleged offence to send you a notice of prosecution. So if your notice of prosecution comes after the 14th day it is null and void, check for case law to back this up. but Gidden Vs Humberside police 2009 is a good one.

Also all these type of offences must be processed at magistrates court within 6 months of the alleged offence, or it is null and void. Also if it is a speed camera, a photo (no matter if it is triggered by some kind of calibration) can not prove speed. That photograph must be corroborated by a second live witness ( a man: or woman:) if it is not, the case MUST be dropped. If you do not tell them this, you are giving consent through silent acquiescence (again) tacit consent. Also did you know they class speeding as a criminal offence? This may sound bad for you but it is actually good if it is from a photo machine. Why? Because în a criminal matter it is not possible to get a conviction on uncorroborated evidence (ie photo machine). Why? because it is a machine it can not attend court and be cross examined, it is basically hearsay therefore inadmissible, so so not worry about those photos of your car So if you get a speeding ticket from a photo machine send a DSAR and ask for the man: or woman: who is the second witness to be brought forward to substantiate the claim. Without that the only man: or woman; who can be a second witness is you by grassing yourself up by agreeing to the offence. So, read this, look in the file section and post no more speeding stuff.
