Council Tax

In Leighton v Bristow and Sutor [2023] in relation to council tax, it was established by a judge that the enforcement agents are duty bound to provide the authority from the court for them to be lawfully entitled to be upon the private property without being trespassed. Because the agents take their instructions from and act upon paperwork provided to them by the council and not the court, they can be immediately trespassed. Mr Leighton won damages of £4,000 for the civil trespass.
