RESPONSE TO SPEEDING OFFENCE NOTICE OF INTENDED PROSECUTION (NIP):

Thank you for your correspondence dated [DATE], in relation to an alleged offence involving a vehicle displaying the registration number [REG NUMBER].
I note that the images provided to me are from the rear of the vehicle, making it impossible for me to attempt to identify the driver of the vehicle at the time of the alleged offence. I feel, therefore, that I have satisfied section 172(4) of the Road Traffic Act (1988), which states:
“A person shall not be guilty of an offence by virtue of paragraph (a) of subsection (2) above if he shows that he did not know and could not with reasonable diligence have ascertained who the driver of the vehicle was.”
Please desist from any future court action in this matter, in order to save public funds being squandered on charges that cannot be proven beyond reasonable doubt. If you decide to proceed to court action, please be aware that I shall attend in person and submit my defence based on the current legislation, and the fact that the vehicle shown in the images provided do not prove beyond reasonable doubt that I was or knew the driver at the time of the alleged offence. The images provided to me could well be one of approximately 1.75 million cloned vehicles (Essex Police estimations) to be driven on UK roads. One can reasonably assume that the estimated figures provided by Essex Police are likely to have increased significantly since the rollout of ULEZ zones and cameras.
Please note that, should you proceed with court action in this matter and lose your case, knowing that you do not possess proof beyond reasonable doubt as to the driver at the time of the alleged offence, or you fail to establish that the vehicle in the images is not a vehicle with a cloned registration number plate, your department shall be invoiced by myself for a sum of £5,000. Failure to satisfy the invoice would result in a claim for a County Court Judgement against your company, which may affect your ability to obtain credit in future.
